Prestige Metering Services is a business in the utility industry that provides a utility management service.

By accessing and using the services provided by Prestige Metering Services (Pty) Ltd (hereinafter “Prestige Metering Services”), you acknowledge and agree to be bound by these Terms and Conditions. Your use of our services constitutes a legally binding acceptance of these terms and an agreement to abide by them.

If you do not agree to these Terms and Conditions, please do not use our services. Continued use of our services implies your ongoing acceptance of these terms.

“Services” refer to the utility management services, including water, electricity, and gas management, as well as the prepaid vending system provided by Prestige Metering Services.

3. Use of Services

3.1 Compliance with South African Laws and Regulations
By using our services, you agree to use them in full compliance with all applicable South African laws and regulations. This includes, but is not limited to, adherence to utility regulations, such as those imposed by the National Energy Regulator of South Africa (NERSA) and prevailing municipal authority for electricity and relevant water utility regulations.

3.2 Right to Refuse Service
Prestige Metering Services reserves the right to refuse service to any user for any reason at any time, provided such refusal is in accordance with South African anti-discrimination laws. We may exercise this right when a user’s actions or behaviour violate these Terms and Conditions or are deemed detrimental to our services or other users.

4. Payment and Billing

4.1 Payment Obligations
Users of our prepaid vending system must make payments for electricity, water and gas tokens and services in accordance with our Payment Policy. Details of payment methods are available on our website.
4.2 Payment Options Accepted
Payment may be made via Visa, MasterCard, or any of our other payment options.
4.3 Card Acquiring and Security
Card transactions will be acquired for Prestige Metering Services via PayGate (Pty) Ltd who are the approved payment gateway for all South African Acquiring Banks. DPO PayGate uses the strictest form of encryption, namely Secure Socket Layer 3 (SSL3) and no Card details are stored on the website. Users may go to www.paygate.co.za to view their security certificate and security policy.
4.4 Merchant Outlet Country and Transaction Currency
The merchant outlet country at the time of presenting payment options to the cardholder is South Africa. Transaction currency is South African Rand (ZAR).

5. Data Protection and Privacy

5.1 Collection and Handling of Personal Information
Prestige Metering Services collects and handles personal information in accordance with our Data Protection and Privacy Policy. This policy fully complies with the Protection of Personal Information (POPI) Act in South Africa. We are committed to protecting the privacy and security of your personal data. 5.2 Customer Details Separate from Card Details
Customer details will be stored by Prestige Metering Services separately from card details which are entered by the client on DPO PayGate’s secure site.

6. Security

You are responsible for maintaining the security of your account credentials. Any unauthorized access to your account or any breach of your account’s security should be reported to Prestige Metering Services immediately.

Prestige Metering Services employs a range of security measures to protect your data. However, it is important to note that no system can guarantee absolute security. Therefore, we cannot be held liable for any breaches of security, data theft, or unauthorized access. By using our services, you acknowledge and accept this limitation.

7. Compliance with Laws

7.1 Commitment to Compliance
Prestige Metering Services is committed to full compliance with South African utility regulations and standards, including, but not limited to, those imposed by the National Energy Regulator of South Africa (NERSA) for electricity and relevant water utility regulations.

This content is protected by South African and international copyright laws. Unauthorized use, reproduction, distribution, or modification of this content is strictly prohibited.

9. Limitation of Liability

9.1 Liability for Damages
Prestige Metering Services is not liable for any indirect, incidental, special, or consequential damages that may arise from your use of our services. This includes, but is not limited to, damages such as lost revenue, lost profits, or financial losses.

9.2 Exception to Limitation
The limitation of liability set forth in Section 9.1 does not apply to damages caused by the gross negligence or wilful misconduct of Prestige Metering Services. In such cases, the limitation is void.

10. Dispute Resolution

10.1 Country of Domicile
This website is governed by the laws of South Africa and Prestige Metering Services chooses as its domicilium citandi et executandi for all purposes under this agreement, whether in respect of court process, notice, or other documents or communication of whatsoever nature.

10.2 Governing Law and Jurisdiction
Any disputes arising from your use of our services will be governed by South African law. Such disputes are subject to the exclusive jurisdiction of South African courts.

11. Refund Policy

11.1 Refund Eligibility
Prepaid Electricity Tokens:
Refunds for prepaid electricity tokens are subject to specific eligibility criteria. Refunds may be issued under the following circumstances:
• A payment was made for electricity tokens, but the tokens were not delivered or were delivered incorrectly. The electricity tokens can also be reissued.
• Duplicate payments were made for the same electricity tokens.
• Overpayments were made on your account, resulting in a credit balance.
Other Services:
Refund eligibility for other services offered by Prestige Metering Services may vary and will be specified in the terms and conditions of those services.

11.2 Requesting a Refund

When requesting a refund, please provide the following details to expedite the process:
• Your account information in the form of a bank confirmation letter.

11.3 Refund Process

Upon receiving your refund request, our customer support team will review and verify the eligibility of your request. This may include confirming payment records and the circumstances of the refund.
Should you have any outstanding balances with Prestige Metering Services, we reserve the right to use the funds to settle those amounts.
Refund Approval:
If your refund request is approved, we will initiate the refund process. The time it takes for the refund to be processed and received by you may vary depending on the payment method.

11.4 Refund Methods
Credit/Debit Card Payments:
Refunds for payments made by credit/debit card will be processed by reversing the transaction to the original payment method. The refund will be processed as quickly as possible, but the timing of receipt may depend on your card issuer’s policies.
Electronic Funds Transfer (EFT):
For payments made via EFT, refunds will be processed by transferring the refunded amount to the bank account from which the original payment was made. (Please note a refund fee will be applicable)
3rd Party Payment Options:
Refunds for payments made through third-party payment options will be processed as per the terms and conditions of the specific payment provider.

12. Changes to Terms and Conditions

12.1 Updates and Changes
Prestige Metering Services reserves the right to update and change these Terms and Conditions at any time. Updated terms will be posted on our website and take effect immediately. It is your responsibility to review these terms periodically to ensure your continued compliance. In the event of significant changes, we may notify you via email or other means.

13. Responsibility
Prestige Metering Services takes responsibility for all aspects relating to the transaction including sale of goods and services sold on this website, customer service and support, dispute resolution and delivery of goods.
